I have a a nitrogen tank that is completely empty, can I fill it up with nitrous oxide?

It is illegal in most states depending on the intended use.

It is also potentially hazardous to breathe.

The tank might not take the same pressure and it is probably involved getting the right fittings. It is a bad idea to put gases in incorrectly marked containers by the way. That likely is illegal or at least irresponsible.
